Code Compliance Statement
Each plan is designed to be consistent with the International Residential Code (IRC) in effect at the time the plan was created. However, Atlas Home Designs LLC does not warrant such conformity. Modifications may be necessary to meet applicable building codes, ordinances, local climatic, and geographical design criteria. Consult a builder, structural engineer or other construction professional as required. Atlas Home Designs LLC specifically disclaims any responsibility for ensuring the plans, and/or any house built using the plans, satisfies local or other applicable building codes. Determining and complying with all applicable codes is the buyers responsibility. Heating/air conditioning layouts and plumbing layouts are not included. Manufacturer instructions should be followed for all materials, appliances, systems and elements. Consult a local mechanical contractor for systems suitable for local climate conditions if required.
Structural Engineering
The process of Structural Engineering is complex, and looks at many factors including, wind loads, snow loads, soil types and load, soil bearing capacity, etc.
Because of this, Atlas Home Designs strongly recommends you have your building plans reviewed by a Structural Engineer and Truss Engineer. Atlas Home Designs does not provide Structural Engineering with our plans. If requested, we will engage a local engineer on your behalf for an additional fee.
Building Officials Requiring Professional Stamps
Depending on your local building official, it may be required for you to obtain professional stamps for your building plans. Atlas Home Designs LLC does not supply these stamps. It is the buyers responsibility to determine which, if any, professional stamps are required for your building plans. If professional stamps are required, Atlas Home Designs will provide PDF and CAD files as necessary to your selected professional to get your plans completed.
Copyright Notice
Copyright and licensing of house plans for construction exists to protect all parties. It respects and supports the intellectual property of the original designer. Infringement, willful or otherwise, may carry severe penalties. The responsible parties are required to pay actual damages caused by the infringement (which may be substantial), plus any profits made by the infringer commissions to include all profits and from the sale of any home built from an infringing design. The copyright allows for the recovery of statutory damages, up to and including $150,000 for each infringement. The infringer is also responsible for paying the (reasonable) legal fees of the original designer, which often exceed the damages.
Return and Exchange Policy
Because each plan purchased shows intellectual knowledge of the product, all sales are final. Please be sure that the plan you selected is the correct one before ordering. Atlas Home Designs LLC maintains a strict no refund or exchange policy. If you have any questions, please contact us.
License Agreement
By using this site, you acknowledge that all properties, including images, descriptions and elements are all protected by copyright law. It is not authorized to use any of these entities without written consent from Atlas Home Designs LLC. Furthermore, any photographed home may have been modified from the original house plans to suite that homeowner’s preference, and may not necessarily accurately represent the original Atlas Home Designs LLC plans.
By engaging and/or purchasing services, or pre-designed house plans from Atlas Home Designs LLC, you agree to the below conditions.
This Agreement is a legally binding contract between the purchaser of the license (“Licensee'“) for the house plan and Atlas Home Designs LLC. This agreement explains the terms and conditions under which the Licensee is permitted to reproduce, modify, and construct a house using the plans and services purchased directly from Atlas Home Designs LLC, or through its website.
Atlas Home Designs LLC grants the Licensee a non-exclusive, non-transferable, non-assignable License to use the house plans as defined in this Agreement. Atlas Home Designs LLC reserves the right to be the sole entity in granting a license to its intellectual property. Atlas Home Designs LLC grants this license to the Licensee only. This license does not extend to any third party entity (i.e. independent designers, sub-contractors, business associates, family member, friends, etc.) This license goes into effect at the time of receiving the first review set sent to the Licensee by Atlas Home Designs LLC, or by the date signed at the bottom of this Agreement.
Any violation of the terms, conditions, or restrictions of this Agreement by the Licensee shall cause the immediate revocation of this license, without notice from Atlas Home Designs LLC. As a result of this revocation, the Licensee will no longer be authorized to reproduce, modify, and construct a house using the plans purchased. Legal action may also be brought against the Licensee in compliance with Copyright infringement law for violating these conditions.
By purchasing services, or pre-designed plans from Atlas Home Designs LLC, the Licensee agrees that all intellectual property, including plans, drawings, photographs, renderings, and any derivative works by Atlas Home Designs LLC are protected under federal copyright law. Atlas Home Designs LLC reserves the right to seek full remedies for infringement under the copyright statutes, including statutory damages up up to $150,000 per infringement plus litigation costs and attorneys’ fees. Any parties involved, including but not limited to, the Licensee, architects, designers, draftsmen, owners, builders, realtors, and print shops, are subject to litigation by Atlas Home Designs LLC.
The Licensee acknowledges that Atlas Home Designs LLC is, and will remain, the owner of the intellectual property described in the above paragraph. The Licensee also acknowledges that the license granted by this Agreement is for a single use license granted for the construction of a single home located at the address or PID specifically identified in this Agreement, and on the house plan provided. The purchase of additional sets of the house plan or as part of a multiple set package does not convey to the Licensee a license to construct more than one home from the house plans. Similarly, the purchase of reproducible house plans digital, or printed carries the same copyright. Up to 15 copies for the construction of the home may be made. Making copies of the house plan does not authorize the use of those copies or any other copies to build more than one home. Any additional use of the issued house plan, or copies of the house plan, or any other intellectual property owned by Atlas Home Designs LLC, is subject to additional licensing fees. The Licensee agrees to contact Atlas Home Designs LLC for details on re-use fees and/or multiple use programs prior to the construction of any additional homes.
The Licensee shall have the right to customize the house plan as necessary to obtain a building permit for the construction of the home at the referenced address or PID. Customizations to the house plan may be made to comply with local building code requirements, structural requirements, material requirements, and owner personalization. All customized versions of the house plan shall bear the copyright of Atlas Home Designs. If customizations are made to the house plan, the Licensee acknowledges that the original house plan, together with any customizations or changes to the house plan, remain the sole property of Atlas Home Designs LLC. The Licensee acknowledges that the house plan, together with any customizations, are non-sellable by the Licensee. Failure to comply with this statement will be in violation of this Agreement and subject to legal action. Atlas Home Designs LLC is free of any and all liability associated with customizations made to any house plan. Any discrepancies or changes of any nature to the house plan is the sole responsibility of the Licensee and anyone involved in the redesign and customization process.
The Licensee may distribute digital, or printed copies of the house plan to third parties as needed to assist in the construction of a single home, as licensed in this agreement. All such copies, digital or printed, must be obtained and/or destroyed except for the owner’s reference set, after such assistance is complete.
Atlas Home Designs LLC reserves the right to make corrections, changes, and /or modifications to its drawings to ensure the accuracy of its plan information. All house plans ordered through Atlas Home Designs are provided as is. Atlas Home Designs LLC disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Furthermore, Atlas Home Designs LLC is not liable for incidental, special, consequential, or indirect damages of any kind, including but not limited to, loss of anticipated profits, business opportunity or other economic loss arising out of plans received from Atlas Home Designs LLC (Even if Atlas Home Designs LLC has been notified of such damage), defects in construction or design and damage caused thereby, the success of the permit submittal process, or the loss or destruction of a digital or physical copy of a licensed Atlas Home Designs LLC plan. Atlas Home Designs LLC’s liability to Licensee or to any third party, shall not exceed the price paid for the original house plan in the event that any liability is imposed on Atlas Home Designs LLC.
Any dispute over the terms of this Agreement, compliance or non-compliance with the terms listed above, or in any issue arising from the use of the license or use of any portion of an Atlas Home Designs LLC plan, must be brought in the state of Minnesota. By purchasing services or plans from Atlas Home Designs LLC, the Licensee agrees to the jurisdiction of such courts over themself and/or their company. Atlas Home Designs reserves the right to take legal action against any Licensee for use that does not conform to this Agreement, infringement on any Atlas Home Designs LLC intellectual property, or other violations of the terms and conditions listed.
By purchasing any services and/or house plans from Atlas Home Designs LLC, the Licensee signifies their agreement to the above terms and conditions.
